El presente documento regula el acceso, navegación y contratación de productos a través del sitio web https://www.barefootislascanarias.com/ (en adelante, el “Sitio Web”), titularidad de Barefoot Canarias, S.L. (en adelante, “Barefoot”), con CIF B70633201 y domicilio social en Calle Antonio Pino Pérez, núm. 1, 38750 El Paso, Santa Cruz de Tenerife, Islas Canarias, España.
Terms and conditions
Los presentes Términos y Condiciones (en adelante, los “T&C”) regulan: (i) el acceso y uso del Sitio Web; y (ii) las condiciones de contratación de los Productos ofrecidos por Barefoot a través del mismo.
Access to the Website grants the status of User and implies acceptance of the T&C, as well as the Legal Notice and the Privacy Policy published on the Website.
These T&C will apply when the buyer is considered a consumer under current regulations.
La formalización de un pedido implica la lectura y aceptación expresa de los T&C en su versión vigente en el momento de la contratación. Barefoot podrá modificar los T&C para adaptarlos a cambios normativos, técnicos o funcionales, sin que dichas modificaciones afecten a pedidos ya formalizados.
For interpretative purposes:
The singular includes the plural and vice versa.
References to regulations will be understood as referring to the current Spanish legislation at any given time.
Expressions such as “including,” “in particular,” or similar will be illustrative and not limiting.
Definitions
For the purposes of these Terms and Conditions, the following terms will have the meaning indicated below:
Barefoot: Barefoot Canarias, S.L., owner of the Website.
Customer: the User who purchases Products through the Website.
Account: the personal space created by the User after registration.
Product(s): the items offered for sale on the Website.
Website: the page accessible at the indicated domain and its associated sections.
User: any natural or legal person who accesses and navigates the Website, regardless of whether they purchase Products.
User and registration
El acceso al Sitio Web es libre y gratuito. Para realizar un pedido no será obligatorio crear una Cuenta, pudiendo el Usuario efectuar la compra como invitado. No obstante, el registro permitirá acceder a funcionalidades adicionales, tales como el seguimiento de pedidos, acceso a promociones exclusivas y participación en el programa de fidelización. Tanto el registro como la realización de pedidos como invitado implican el tratamiento de datos personales conforme a lo previsto en la Política de Privacidad [incluir enlace] del Sitio Web.
The User agrees to provide truthful, accurate, and complete information during the registration or purchase process, as well as to keep their data updated at all times.
La Cuenta es personal e intransferible. Las credenciales de acceso deberán ser custodiadas de forma diligente por el Usuario, quien será responsable de las actividades realizadas a través de su Cuenta cuando exista un uso negligente de las mismas. El Usuario deberá comunicar a Barefoot, a la mayor brevedad posible, cualquier uso no autorizado de su Cuenta o incidente de seguridad del que tenga conocimiento. Barefoot no será responsable de los daños derivados del uso indebido de la Cuenta cuando dicho uso no sea imputable a una actuación negligente por su parte.
The use of automated tools, bots, or any other mechanism intended to make bulk purchases, alter the normal functioning of the Website, or evade its security systems is prohibited.
Barefoot podrá suspender o cancelar la Cuenta cuando existan indicios razonables de fraude, suplantación de identidad, utilización indebida del Sitio Web o incumplimiento de los presentes T&C. Asimismo, podrá cancelar Cuentas que permanezcan inactivas durante un periodo prolongado y razonable, previa notificación al Usuario cuando resulte posible. Barefoot podrá asimismo restringir temporalmente el acceso al Sitio Web en caso de uso abusivo o contrario a los presentes T&C.
La adquisición de Productos a través del Sitio Web se realiza para uso personal y no comercial. Barefoot podrá limitar o cancelar pedidos cuando existan indicios razonables de adquisición con fines de reventa o distribución no autorizada.
In the event that the User acts on behalf of a legal person or entity, they declare that they have sufficient authority to bind it to the present T&C.
Purchase process and formalization
To place an order on the Website, the User must provide the necessary data for processing the purchase, either through prior registration or as a guest.
The purchase process will be carried out through the following steps:
Selection of the desired Product or Products and addition to the cart.
Review of the shopping cart, where the User can check the details of the selected Products, their price, applicable taxes, and, if applicable, shipping costs.
Confirmation of the shipping address and selection of the payment method.
Final review of the order, with the possibility to correct errors before proceeding to payment.
Express acceptance of the present T&C by checking the corresponding box.
Confirmation of the order by activating the button enabled for that effect, clearly identified as “order with payment obligation” or an equivalent expression, which will imply the assumption of the payment obligation by the User.
El contrato se considerará formalizado en el momento en que Barefoot confirme la aceptación del pedido mediante el envío de un correo electrónico de confirmación al Usuario, en el que se incluirá un resumen de la compra realizada.
VOLKANKNARY will not be obligated until the express confirmation of the order.
Barefoot podrá no aceptar o cancelar un pedido antes de su confirmación cuando concurran circunstancias excepcionales debidamente justificadas, tales como errores manifiestos en el precio, indisponibilidad sobrevenida del Producto o indicios razonables de fraude. En caso de haberse realizado el cargo correspondiente, Barefoot procederá al reembolso íntegro de las cantidades abonadas a la mayor brevedad posible.
In case the payment is not authorized by the corresponding entity, the purchase process will be automatically canceled.
The User will receive the order confirmation in a durable medium, being able to keep that information for future reference.
El contrato podrá formalizarse en idioma español. Barefoot no archivará individualmente el contrato en soporte distinto del propio sistema interno de gestión de pedidos, sin perjuicio de que el Usuario pueda acceder a su historial de compras a través de su Cuenta cuando esté registrado.
Loyalty program
Barefoot podrá ofrecer a los Usuarios registrados la posibilidad de participar en un programa de fidelización, cuyo funcionamiento, ventajas y condiciones específicas se detallarán en el Sitio Web en cada momento.
Participation in the program may allow the accumulation of benefits, discounts, or promotional balances applicable to future purchases. Such balances or benefits will be exclusively promotional, do not constitute electronic money nor generate a right to cash reimbursement, and may only be used in accordance with the conditions in effect at the time of their application.
Unless expressly stated otherwise, the accumulated balances or benefits will have a limited temporal validity and will not be transferable to third parties.
Barefoot se reserva el derecho a modificar, suspender o cancelar el programa de fidelización en cualquier momento por razones técnicas, operativas o comerciales, respetando en todo caso los derechos ya consolidados por los Usuarios conforme a la normativa aplicable.
Products and availability
The Website offers online sales of footwear and other items related to the Barefoot brand.
The descriptions, characteristics, sizes, and images of the Products shown on the Website are for informational purposes and are displayed as accurately as possible. However, there may be slight variations in colors, shades, or finishes depending on the device from which they are viewed or manufacturing processes.
All orders are subject to the availability of the Products at the moment of order confirmation.
VOLKANKNARY makes reasonable efforts to ensure that the information regarding the availability is accurate and properly updated. However, there may be occasional incidents arising from technical errors or discrepancies in the inventory system.
En caso de que, tras la formalización del pedido, el Producto solicitado no se encontrase disponible por causas no imputables al Usuario, Barefoot informará de dicha circunstancia a la mayor brevedad posible. En tal caso, el Usuario podrá optar entre aceptar un nuevo plazo de entrega si el Producto estuviera previsto nuevamente en stock o resolver el contrato con el reembolso íntegro de las cantidades abonadas.
Barefoot no realizará sustituciones de Productos sin el consentimiento previo y expreso del Usuario.
Price and payment
Los precios de los productos se muestran en euros (€) e incluyen los impuestos indirectos aplicables (IVA/IGIC), salvo que se indique expresamente lo contrario. El precio no incluye los impuestos y aranceles que pudieran resultar exigibles conforme a la normativa aplicable en caso de envíos fuera del territorio fiscal correspondiente.
The price of each product will be the one indicated on its sheet at the moment of confirming the order. If there is a promotion or discount, it will be applied before completing the purchase and will be reflected in the order summary.
En caso de que se detecte un error evidente en el precio, Barefoot informará al Usuario y le ofrecerá la posibilidad de confirmar el pedido al precio correcto o cancelarlo con el correspondiente reembolso.
Unless expressly stated otherwise, shipping costs are not included in the product price. If applicable, they will be indicated in detail before order confirmation.
Barefoot podrá modificar los precios en cualquier momento. No obstante, los productos se facturarán sobre la base del precio vigente en el momento de la confirmación del pedido.
El pago podrá realizarse mediante los medios habilitados en el Sitio Web en cada momento. Barefoot no almacena datos completos de tarjetas bancarias, siendo la gestión del pago realizada a través de proveedores de servicios de pago seguros.
In the event that the payment is not authorized, the order will not be processed.
Shipping & Delivery
VOLKANKNARY will ship to the territories indicated on the Website at each moment. Estimated delivery times will be indicated during the purchase process and will begin to be counted from the confirmation of the order. In general, shipments within the EU territory will be delivered within an estimated period of between two (2) and (5) days from the confirmation of the order, except for logistical or weather incidents that may affect transportation.
In every case, unless a shorter period is indicated during the purchase process, delivery will be made within a maximum period of thirty (30) calendar days from the order confirmation, in accordance with current regulations. If VOLKANKNARY foresees that it will not be able to meet the deadline, it will inform the User as soon as possible. In the event of a significant delay, the User may choose to either maintain the order or terminate the contract with the corresponding refund.
Barefoot no será responsable de retrasos debidos a causas ajenas a su control razonable, tales como incidencias logísticas, fuerza mayor, huelgas o restricciones administrativas.
El Usuario deberá facilitar datos de entrega exactos y completos. Si la entrega no pudiera realizarse por causas imputables al Usuario (dirección incorrecta, ausencia reiterada u otras circunstancias similares), Barefoot podrá repercutir los costes adicionales derivados de un nuevo intento de entrega o, en su caso, de la devolución del envío.
Delivery will be understood as completed when the User or a third party indicated by them takes possession of the product. The risk of loss or damage will transfer at that moment.
Return and withdrawal policy
The Customer may return or exchange the Products purchased through the Website within a period of fifteen (15) calendar days from the receipt of the order. In any case, the Customer has the legal right to withdraw within the first fourteen (14) calendar days, without the need to justify their decision, in accordance with Royal Legislative Decree 1/2007 (TRLGDCU).
Para ejercer el desistimiento, solicitar un cambio o gestionar una devolución, el Cliente deberá comunicar su voluntad por correo electrónico (ventas@barefootislascanarias.com) o por cualquier medio que permita dejar constancia de su solicitud.
En caso de desistimiento, el Producto deberá devolverse en un plazo máximo de catorce (14) días naturales desde la comunicación. El Cliente podrá manipularlo únicamente en la medida necesaria para comprobar su naturaleza, características y funcionamiento. El Cliente será responsable de la disminución de valor del Producto cuando resulte de una manipulación distinta a la necesaria para su comprobación. Barefoot no podrá rechazar el desistimiento por dicha manipulación, sin perjuicio de la correspondiente compensación por la pérdida de valor.
The Product must be returned in its original packaging in reasonable condition. Shipments with postage due will not be accepted.
Si el Cliente solicita la recogida en su domicilio, Barefoot podrá gestionarla a través de su operador logístico. El coste de la recogida será de quince (15) euros por envío y será asumido por el Cliente, descontándose del importe a reembolsar. El Cliente podrá optar alternativamente por realizar el envío por sus propios medios, asumiendo en ese caso los costes directos de devolución. En caso de Productos defectuosos o falta de conformidad, los gastos de recogida o devolución serán asumidos por Barefoot.
Una vez recibido el Producto o acreditada su devolución, Barefoot procederá al reembolso en un plazo máximo de catorce (14) días naturales desde la comunicación del desistimiento, pudiendo retenerlo hasta la recepción del Producto o hasta que el Cliente haya presentado prueba de su devolución, según qué condición se cumpla primero. En caso de desistimiento legal, el reembolso incluirá los gastos de entrega estándar abonados en la compra.
Liability
VOLKANKNARY commits to ensuring that the Products offered through the Website comply with current regulations and the description contained in each product sheet, being liable to the Customer for any lack of conformity under the terms provided in the applicable legislation.
The Customer is responsible for using the Products in accordance with their nature, purpose, and instructions for use. Barefoot will not be responsible for damages resulting from improper, negligent use or contrary to the provided instructions, nor for normal wear and tear resulting from ordinary use.
Barefoot no garantiza la disponibilidad permanente del Sitio Web ni la ausencia de interrupciones o errores técnicos derivados de causas ajenas a su control razonable, incluyendo supuestos de fuerza mayor o actuaciones de terceros.
The Website may contain links to third-party pages for which Barefoot assumes no responsibility regarding their content, policies, or practices.
En ningún caso Barefoot responderá por daños indirectos o perjuicios que no resulten previsibles conforme a la normativa aplicable. Su responsabilidad, en cualquier caso, quedará limitada al importe efectivamente abonado por el Producto objeto de la reclamación, sin perjuicio de los derechos reconocidos al Cliente cuando tenga la condición de consumidor conforme a la normativa vigente.
Personal data protection
In compliance with Regulation (EU) 2016/679, of April 27, 2016 (GDPR), and other applicable regulations regarding data protection, Barefoot Canarias, S.L. informs the User and/or Customer that it is responsible for processing their personal data, which will be processed for the purpose of executing and maintaining these Terms and Conditions, managing, developing, and administering the contractual relationship, as well as fulfilling the legal obligations arising from it.
The legitimacy of the processing is based on the execution of the contract, the fulfillment of legal obligations, and, where applicable, the consent of the data subject. The data may be communicated to public administrations and/or competent authorities when necessary for the fulfillment of legal obligations.

Account suspension and cancellation
Barefoot podrá suspender o cancelar la cuenta del Usuario cuando existan indicios razonables de uso fraudulento, ilícito o contrario a los presentes Términos y Condiciones.
The suspension or cancellation of the account will not affect any orders previously formalized or the rights that correspond to the Customer in accordance with applicable regulations.
In the event of account cancellation, access to the functionalities associated with it will cease, without prejudice to those provisions of these Terms and Conditions that, by their nature, must remain in effect.
Intellectual and industrial property
All content of the Website, including, by way of example, but not limited to, texts, images, photographs, designs, logos, trademarks, trade names, videos, structure, graphic design, and source code, are owned by Barefoot Canarias, S.L. or have the necessary licenses or authorizations for their use.
The reproduction, distribution, public communication, transformation, or any other form of exploitation, in whole or in part, of the contents of the Website is prohibited without the prior written authorization of Barefoot.
Access and navigation of the Website do not imply in any case the transfer or waiver of intellectual or industrial property rights.
General provisions
If any of the clauses included in these Terms and Conditions is declared, in whole or in part, null or ineffective by a final resolution of a competent authority, such nullity shall not affect the rest of the provisions, which shall remain in full force and effect.
La falta de ejercicio o el retraso en el ejercicio por parte de Barefoot de cualquier derecho o facultad reconocidos en los presentes Términos y Condiciones no constituirá renuncia a los mismos.
Barefoot podrá ceder los derechos y obligaciones derivados de los presentes Términos y Condiciones a terceros en el marco de procesos de reorganización empresarial, fusión o transmisión de actividad, garantizando en todo caso el mantenimiento de los derechos del Cliente. El Cliente no podrá ceder sus derechos u obligaciones sin el consentimiento previo y expreso de Barefoot.
These Terms and Conditions constitute the entire agreement between the parties regarding their subject matter and replace any prior agreement that may exist in this regard.
Applicable law and jurisdiction
These Terms and Conditions shall be governed and interpreted in accordance with Spanish legislation.
In the event of a dispute or conflict arising from the interpretation or execution of these Terms and Conditions, the parties shall submit to the courts and tribunals of the Client's domicile when they are a consumer, in accordance with the current regulations on consumers and users.
